Mediation is a voluntary civil process for settling disputes as an alternative to trial. Mediators are trained, neutral facilitators who guide parties in dispute through a structured interactive process which leverages proven communication and negotiation techniques, to help parties arrive at a mutually agreeable resolution. Mediations may occur either in court, at the encouragement of the judge, prior to the scheduled trial, or outside of court.
Arbitration is an out-of-court process for resolving a (contractual) dispute between parties, where a trained arbitrator who is empowered to decide the outcome based on the evidence presented by the parties, serves as an impartial third party. Arbitration can be used as an intermediate step between mediation and litigation to address unresolved issues not settled by mediation. Like mediation, arbitration is more expedient and cost-effective as compared to litigation. Decisions made by the arbitrator may be either binding or non-binding, depending on the type of case or the terms of the arbitration agreement.
Litigation (civil) is the legal process for settling a dispute in a court of law. Parties to a dispute are summoned to a court of jurisdiction to participate in a trial where they present their cases and supporting evidence before a judge, who decides the outcome based on the merits of each case and the applicable rule(s) of law.
